Legal Question in Wills and Trusts in Alabama

Help with debt options of deceased brother-in-law.

My brother-in-law died a couple of weeks ago. He was 37, never married, nochildren. He had no medical insurance or life insurance. He got sick went to the hosp., they put him in ICU and he died a week later...sill in ICU. My husband is his only sibling. Both parents are deceased. We had an attorny draw up papers nbaming my husband as Guardian over his estate. He had no money, amybe 75.00 in the bank. He has no vlauables. He owned a house and 2 acres of land that we have appraisal paperwork on from 2 years ago. It appraised at 75,000.00. He owed 10,000.00 to the IRS for back taxes. He had taken out a small mortgage on his house for 20,000.00. We had sarted getting in the hosp. bills now. They are at 90,000.00 and still have yet to receive bills from the Doctors. Is there any agency that could help pay these bills or what are the chances of the creditors ''writing'' these debts off? We want to avoid selling the house if possible, my husbands father built it with his own hands. I understand about his debts having to be satisfied, I'm grasping at straws here.

The short answer is that the hospital is out of luck on their debts. They can get in line with the IRS as a creditor of his estate and maybe, perhaps, just might be able to get something at the end of the six month period. However, as for you and your husband, you have no obligation, legal, moral or otherwise to pay these debts. Do not agree to do so. You might consider looking into a medical malpractice cause of action depending upon the circumstances of your brother in law's death too. That is an entirely different issue but one that might produce results.
