Legal Question in Wills and Trusts in Alabama

Are we entitled to our fathers share?

My grandfather recently passed away..My father passed away many years ago.. If my grandfathers will reads for it to be devided equally between my ''living'' children, can he exclude a child that has passed away? Do we have any right to what would have been our fathers share or since he is dead it gets devided between the other children?

Lawyers can speculate about this but you probably want a specific answer. The only way you will get one is to bring in a copy of the actual will so the precise language can be determined. Per stirpes, per capita or something else matters in the interpretation, and whether a lawyer drafted it or he copied it from some form at Office Depot matters as well. Contact Wallace and Glass up there and get them to look at it.
