if an heir is not located how long befor the heir is excluded from the estate??

The heir should never be excluded. His or her share should be deposited in the registry of the court.

Never, in Texas. The missing heir's portion should be placed in a trust account or deposited into the court's registry and kept until the heir, or heir's descendants, are located.
