Legal Question in Wills and Trusts in Alabama
Family estate
My mother passed last year. She was married to her last husband for one year, before passing. Since her passing, he has changed the locks on our family home, I was still sharing with my mother. He has destroyed her will, but I have the original deed to the house that my mother completely paid for. The deed to the house is titled to her aires, which is myself and two other sisters. How do we remove him from the property ?

I see you are writing from Mobile. I strongly encourage you to contact a lawyer there to seek his/her assistance. If your mother's home was in another county in Alabama, try to find an attorney close to the county or in the county where the house is located. Davis & Neal and Jim Zeigler are both great lawyers down Mobile way. This is not something that can be answered hypothetically. You need to visit a lawyer. Soon.

If he is not listed on the deed and there is no other will, then you might file to probate her estate. You NEED a lawyer. You can probably find a good lawyer in the County where your mother passed away.
