Legal Question in Wills and Trusts in Alabama
My family and I live in a house on commercial land. Recently, they built a new road going close to our house. To build this road, they had to remove most of our septic field line. If you are unfamiliar with septic systems, field line is what lets excess water from showers, sinks, dishwashers, etc., all irrigate throughout the yard over a large area, basically like an underwater sprinkler. Without this, septic water can build up, and overflow back into drains, pipes, and the yard. We recently discovered that we are having overflow because the water. This is very unhealthy and is starting to cause property damage. Since this is commercial land, we have to PAY THE CITY if we want it fixed. If we don't get it fixed the house can be condemned and we can be fined HARSHLY.
Doesn't this seem like it is the city's fault? Is there action we could take to have the city repair this on their expense?
