Legal Question in Wills and Trusts in Alabama

My father passed away on December 29, 2001 and we are still looking for the Will. We know there is one, just haven't located it yet. We are wondering though if wife is sole survivor in Alabama, if joint accounts will need to be probate and if accounts with only father's name will need to be probated. What about federal penalties, taxes, etc. If some money is used and probate is done one year later, does the money spent the year before go into probate also.

Just a quick reply concerning joint accounts - all joint accounts, regardless of whether with a spouse or not, pass outside of the estate. They become the sole property of the survivor upon the death of the other tenant.
