Legal Question in Wills and Trusts in Alabama

fathers estate-no will

In our grief, we elected our sister to be executor over our fathers (very small) estate. It's been nearly a year and a half and everything is in turmoil. She has spent the majority of the money (cash and emptied 2 checking accounts that we know about.) We cannot get her to show us any bank records etc. Our attorney seems very indifferent. There is a cd and another in question (I opened the maturity letter just days after his death, she insists I was mistaken. We really don't know where to turn to have this matter resolved or what first step to take. It's tearing our family apart. Please advise.

Very sad to hear of your problems. You never truly know someone until you go through probate with them. Your message raises several issues and questions. One is the attorney you mentioned. Who specifically is he representing? The estate, the executor, who? That makes a huge difference so please be specific. Second, who appointed your sister to be the executor? Do you mean Administrator? If so, she owes the court and the heirs a duty to account for every penny. You can demand that through an attorney and Tuscaloosa has a great many good ones. You need to get one soon though. Good luck.
