Legal Question in Wills and Trusts in Alabama
My husband passed away eleven years ago,with no will. I therefore had to go through probate to settle the estate. I received a notice of court hearing with attendance required.I have made several attempts to contact my attorney of record,But he will not return my calls. I did research on the probate court website and found where the claim in question had been cancelled. My question is, if the attorney does not call my back by the court date,what should I do on my behalf? Should I get another lawyer or just pay the claim in question? I don't feel I should have to after eleven years, but I will if it is less money than finding another lawyer with only days for he or she to research and represent me. Please tell me what to do.

Not having all the facts it is difficult to tell you exactly what to do but in general I would suggest that you show up at your hearing and tell the judge that the case was resolved year's ago and that the claim is without merit. Tell the judge that you attempted to contact your attorney but he/she did not return your calls. I believe that if your case was dismissed, the claim will also be dismissed. Of course, you are also welcome to have another attorney represent you and that would be preferable assuming you have the funds. Contact your local bar association to get a referral for a Probate attorney in your area.
