Legal Question in Wills and Trusts in Alabama

Legality of will of non-citizen

I have been requested to type a last will and testament for a person in Alabama, who is a citizen of another country. She was awarded property in a divorce degree, but would this will be legal or would property revert to former spouse?

Unless you are an attorney it sounds like the unauthorized practice of law to me. The Georgia Bar just issued an ethics opinion clarifying that preparing closing documents and property deeds was the unauthorized practice of law, unless done by an attorney. While wills are not specifically mentioned, it is easy to draw an analogy between the two. Additionally, you should insure yourself against the beneficiaries of the deceased who may sue you if you draft the will incorrectly.
