Letter of Administration

What must I do to prepare a Letter of Administration? My wife passed away in February and we had a will made out years ago; however, I am not sure that I can find it. What procedures are necessary?

If she had a Will, you would obtain Letters Testamentary in order to serve as her Executor. If she did not have a Will, you would obtain Letters of Administration to serve as her Administrator. Either way you have to go through Probate Court to be appointed. You will need an attorney to prepare the Petitions to do that. You might be able to avoid probate entirely if your assets were all jointly-owned. I suggest contacting an attorney in your area to consult with on this case. It should not be expensive.
