Legal Question in Wills and Trusts in Alabama

My mother signed about 3 or 4 different durable power of attorney forms. The last one was in Sept of 2005 assigning the lawyer to be her poa. However, recently my brother had the atty office to file one in probate court that was done in February of 2004. Is this legal?
