Legal Question in Wills and Trusts in Alabama
Mother has willed house to brother and I (50/50)
My drug addicted 35 yr. old son also resides in house, (unemployed, no assets).
Son has the typical background/no credit/payment skips of an addict.
My mother and I want son to continue to have place to reside after mothers demise.
My broke brother will want to cash out regardless of my son.
I won't be able to afford to buy him out of his 50%.
Should she:
a) change will to stipulate the 3 of us at 33% share?
b) will son's legal problems become ours with regard to his newly accquired 33% of house?
C) What should I do? I am the executor of the will.

I think you need to meet with an Elder law attorney and bring your mother in with you to discuss these issues. There are solutions but this site would not be the proper forum to resolve your problem.
