Legal Question in Wills and Trusts in Alabama

Mother's death

My mother died without having a will and I'm not able to obtain her account information regarding her mobile home. The company won't release any information because she was the only one on the account. I was told that I need to go through probate but her home is about to be in foreclosure and we want to pay it off. I can't call the company to obtain the payoff balance because the call is directed to the account manager and he's not releasing any information. Is there a legal way to obtain the payoff balance on her home without going through probate?

Re: Mother's death

The finance company seems to be nitpicking but since you could be anyone, they won't release the information without some indication of your authority. You could let it go into foreclosure then buy it from them at the Sheriff's sale if you want the trailer, but you won't be able to negotiate with them about your mom without appointment as Administrator of the Estate by the Probate court there. It doesn't cost that much to do so. Or you could have Mobile County, if that is where you are, use the County Administrator to handle it.
