Legal Question in Wills and Trusts in Alabama

Parents home

Our father died in 2004, we were told he left no will, even though he stated he had(to daughter). Our step-mother has no children. Will we inherit the family home or can our step mom leave it to whoever she wishes.

This is unfortunately one of those "It Depends" questions. It depends on how the property was titled at your father's death and the widow's statutory election amount. Consult with a probate attorney in the Montgomery area,(Ron Holtsford is a good one) to determine what rights you might still have.
