Legal Question in Wills and Trusts in Alabama

My parents Will said all properties are to be split equal but my sister felt that the house was left to her. The attorneys have instructed to her, it is a 50/50 ownership. I would like to sell my 50% and

have come up with several plans, but she is dragging her feet and refuses to get back with me. I have

made several suggestions to her. 1) an equity line 2) pay rental to me 3)reverse equity, where her

equity reverts back to me over 25 years. She is living in the house. It has been 4 1/2 years since my

mother's passing. What are my options?

4.5 years is too long to drag this out. Give her a couple more options. One, you plan to sell your 50% to the first person that responds, regardless of their undesirable characteristics and she can then share her house with whoever YOU choose. The other option is a suit for Partition of the Real Estate, which is brought in Circuit Court to judicially divide the property. Most likely the judge would simply order it sold and the money would then be split. Let me know if I can help. www.NolanElderLaw.com
