Legal Question in Wills and Trusts in Alabama
power of attorney
my question involves a brother who got poa of my mother thru notary public. He is putting everything in his name, states she doesn't own anything, controls her assets, and purchased a new home for himself and put her house up for sale. Her attorney Joe Propst of Decatur, ala already knows her wishes since 2000.Should I contact mom's attorney or wait to probate her will?

Re: power of attorney
Your mother's attorney is her attorney, not yours, so he may not be willing to talk with you. However, it is worth a shot to contact him and inform him of what you suspect to be foul play. All agents under powers of attorney owe the principals a high standard of ficucuary responsibility. It is possible that he has breached that duty. Ask her lawyer.
