Legal Question in Wills and Trusts in Alabama

rights of common law wife

I lived with a man for 25 years, he did not leave a will. He lived in my home but owned real estate, what are my rights?

Re: rights of common law wife

If you lived together at the time of his death AND you both held yourselves out to be husband and wife AND neither of you were married to anyone else, you may be able to establish that you were married to one another sufficient to receive spousal benefits in the administration of his estate. This presupposes that his estate is still open. Your spousal share would consist of a percentage value of his estate, not necessarily the real estate itself. You should contact an attorney. There are plenty of good lawyers in NW Alabama.
