Legal Question in Wills and Trusts in Alabama
My former step brother got a attorney to handle the probate on my fathers estate. It's been 90 days and nothing has been done to start probate. What do I need to do to get probate started.

There is no law that requires an Executor to begin the process immediately. If you think that the estate is at risk for some loss though, you can compel the probate by requiring the relative to produce the will. You would need to hire a local attorney to help though, so I suggest getting a lawyer who handles probate matters in the county where your father died.
