Legal Question in Wills and Trusts in Alabama
Will, Domestic Partner & Children
I wish to will my domestic partner a
property, which she would sell after
my death. Should she NOT need the
money for medical or caregiver care--
the primary reason for my bequest--I
would like my two sons to inherit the
proceeds from the house sale. (This
is her wish, also.) Can this kind of
arrangement be written into my will?

Re: Will, Domestic Partner & Children
You can do almost anything you want with your property either through a Will or a revocable trust. Why not visit a lawyer who works in the estates and trusts field to discuss this? It shouldn't cost you much and some lawyers give free consults for issues like this. Call around to find one who can help you out. If you do it yourself I can just about guarantee that it won't go the way you want it to. We have a plumbing company here in Birmingham. Their motto is "We repair what your husband fixed!" Same goes for the law when a lay person tries to do it. Only problem is by the time the mistake is known it is too late to do anything about it.
