Legal Question in Wills and Trusts in Alabama
No Will
My father died 28 yrs. ago with not will. After 8 yrs. My two brothers and I were told to go to a storage unit and get what we wanted, all that was there was junk. Two weeks ago my grandfather died on my dads side. Do my brothers and I have any rights to the portion of the estate that would have belonged to my dad if he were still alive? We were left nothing.

Re: No Will
Your message does not state whether your grandfather had a will. If he had a will the terms of the will control. If he did not have a will you do indeed have a right to inherit your dad's portion of the estate. The real question is there anything worth fighting for? Did your grandfather have significant real estate holdings? Was he wealthy when he died? If so, he probably had a will and the terms control. But don't take your relatives word for it.
WRT to your father's estate, there are many issues: Was he married at the time? To your mother? Did he own any real estate. Just because it has been 8 years doesn't mean it's too late.
My advice: get a lawyer in your area to look it over. If it's worth fighting for, than do it. You shouldn't be cut out of your grandad's estate just because your dad is dead.
