Legal Question in Wills and Trusts in Alabama

No will left by mother

Hello, Could you please tell me what is the difference between doing a ''division of estate'' and going through probate. My sister and I were told by our mother we were to have her property and home and contents and our brother and his wife were told they had been given a small farm in thier name and helped enough finacially through the years that they had already received thier part. He is now fighting us for a childs part, he knows without a will its the law that he and his wife should get a third. [there are 3 of us] We hired a lawyer and are doing a division of estate. We have offered several deals with no success. What I want to know is, will there be a chance the judge may rule in our favor? He had not ever helped or even visited our mother for the last 10 years of her life. Even though she gave them money on several occasions even paying their house out of foreclosure just months before her passing. He also had verbaly, mentally,physically and even sexually abusing us as children. He had kept our parents in debt all his life in and out of jail and even a stint in prision. He even abused and scamed our mother even though she still cared for him. He is a dispicable human being and our entire family knows everything he did.
