Legal Question in Workers Comp in Alabama
Benefits termination and settlement stalling.
I was disabled in an AL work accident. My benefits stopped after 52 wks. I have been declared disabled to perform in my occupation of 29yrs. My AL attorney appears not to be able to complete settlement with the WC claims people. This has continued since 1999. Is there any reason why these cases take so long. How long am I supposed to draw benefits and how can I expedite a final settlement?

It is very difficult for me to answer these questions without knowing more facts: when were you injured?, What was your injury?, what is your work experience?, what is your education level?, how old are you? Who did you work for and what were your job duties at the time of the injury?, did you receive temporary total disability from workers comp, and if so, how much? has the doctor put you at MMI (maximum medical improvement), and if so, when? what is your impairment rating, or did the doctor give you one? have you had an FCE (functional capacities evaluation) or a vocational assessment? Has your attorney filed a lawsuit?
Usually, the delay arises due to the assessment of your injury. If you would like, you could e-mail me your answers or give me a call (205) 254-3927. I hope this helps.
