Legal Question in Workers Comp in Alabama
company obligations
I was at work and sat in a new office chair purchased from a furniture supply company and just as I sat down one of the bottom pieces broke and threw me backwards out of the chair onto a cement floor where my back and the back of my head hit the floor. I already suffer with 2 herniated disc and osteoarthritis in my back as well as rheumatoid arthritis in my right knee and leg. Who is responsibile for this? I am in a lot of pain.

Perhaps everyone. It will really depend on your injuries. You were injured at work so workers comp would apply and you may be able to sue the furniture company and chair manufacturer. Although you had earlier back issues, the real question is WHAT NEW OR EXACERBATED INJURIES DO YOU SUFFER NOW? The answer to that question will make the difference between "just a comp case" and a defective products case. If you have questions feel free to contact me.

If you were on the job and doing what you were supposed to be doing, you would have a potential workers compensation claim against your company. You may also have a claim against the furniture supply company and/or manufacturer of the chair depending on what caused it to break (assembly or manufacture). If it was the assembly of the chair by the furniture company, you would have a negligence claim against them. If it was the manufacturer, it would depend on the extent of your injuries as to whether you would have a products liability claim (these can get expensive, and unless the injuries warrant it, you cannot bring such a claim due to the economics).
