Legal Question in Workers Comp in Alabama

Permanent Partial disability

I was injured on the job 8-2-2004 I ruptured a disc in lower back. Employer has been very good to me and W/C Ins. have been no trouble.Employer even paid me 1/3 of my wages to make up for TTD differences. I had microdiscectomy surgery on 9-26-2004. The doctor has returned me to work starting 11-30-2004 on light duty untill 12-29-2004. The question is about PPD payment. Will the WC Ins. company contact me about it or is it something I have to ask them for. The doctor never said anything to me about MMI or PPD rating. I have not talked to an attorney because things have been going smoothly and I really like my job and employer. Thank You

Sometimes the workers comp carrier will address it, and sometimes they won't. You have 2 years from the date of the last TTD payment to bring a claim if you need to. If you can return to your old job making the same wage you were making, you will only be entitled to the impairment rating the doctor gives to you. However, if you cannot return to your old job, you would be entitled to a vocational disability. Given what you have said about your employer and carrier, it sounds like they will address this with you and take care of it.
