Legal Question in Workers Comp in Alabama

termination

I reached MMI 6 months ago and was put on permanent restricions by wc doctor. My employer sent me home with no pay, no wc compensation, but continues to pay my private insurance benefits. They say there are no jobs available within my restrictions but I'm still employed. Am I? If I find another job have I quit or was I fired?

You need to find out from the doctor what your permanent impairment rating is. Once you have such a rating, you may then determine whether or not you have a vocational disability. If they don't have a position that meets your restrictions and they are not paying you, you are entitled to compensation. For a more complete analysis of your situation, I would need to know what type of injury you had, what medical treatment you received, how many weeks of TTD you were paid, what your average weekly wage was (or amount of your TTD checks), what your educational background is, and whether you have undergone an FCE (functional capacities evaluation).
