videotaping consent

is it required to obtain a person's consent when you are videotaping in a public area such as outside, in a restauraant, nightclub, or bar? i was just wondering because of the recent case involving a lady who sued the ''girls gone wild'' video company. is their consent required if the video being taped is to be sold to the public or if the video being shot is just for recreational use?

If the subject has a reasonable expectation of privacy, then you would need a release. Presumably you would have to pay some consideration for the release.
