Adoption by a non-step parent

my daughter is 2, when her biological father and I divorced, I was awarded full physical and leagal custody of her, he has had no contact with her since her birth. i have been with another man for over a year now and he has acted as her father for the entire time. we dont plan to marry for another 2 years but he wants to adopt her now, can we do this?

Yes, your boyfriend can adopt, assuming a judge gives ultimate approval. The adoption will require your consent and the consent of your ex-husband (since he is the child's presently existing legal father).

If your ex-husband has voluntarily and intentionally had no contact with the child for the past year, and has not contributed or attempted to contribute to the support of the child, either directly or indirectly, the adoption may be accomplished even without his consent.
