Legal Question in Family Law in Alaska
Child Support in Job Corps
Stepdaughter lives in Alaska, but Idaho has jurisdiction until she's 19 or grads HS (whatever comes later), but support ends at 18 (in paperwork).
She will be 18 in March, '04. She has enrolled in Job Corps in Alaska which provides a stipend, living expenses, medical benefits, and a ''career'' account even though she will still be living with her mother (they have a residential option). Also, family income must not exceed a certain amount. We are aware that the mother provided her income only, and did not include her husband's.
Alaska law provides termination of support at 18 or 19 if enrolled in HS, or equivalent and is residing w/custodial parent. Idaho law ''when child turns 18 or 19 by court order if child is enrolled in formal education.
It is apparent that the mother is pushing for another year's child support.
Would we be paying support until she's 19 although Job Corps provides all benefits?

Re: Child Support in Job Corps
If as you say, Idaho Courts have jurisdiction, then Idaho law applies regardless of where she lives.
Generally, the income of a spouse who is not the parent of a child is not considered.
Idaho Code 32-706(2) is the relevant code section and provides that the court, at its discression, may order payments subsequent to the child reaching 18, until the child reaches age 19, or until the child discontinues their high school education.
You will need to check what your support order requires of you. When does/has your daughter discontinued high school? If she has already quit support would usually end on her 18th birthday.
Again, check your support orders terms. If I can be of any additional asitance please call at 208.883.4410
