Legal Question in Family Law in Alaska
Custody of a Child Out Of State
I received full legal and full physical custody of my child when his father and I got a dissolution in the State of Alaska. The father is to receive visitation during the summer. However,I have since remmarried as well as he ...and I have moved out of state. I let our son go to visit his dad early with the agreement that our child could stay until after the Xmas holiday. However,he has continuoulsy ignored my weekly phonecalls to talk to my son and we agreed about 2 months ago for our son to return right before Xmas. Since then he will not answer his phone nor will he return my calls and I have no other way to contact him. ALthough my parents have gone over to his house and spoke with him to his face telling him to please call me and he never does.I am 7 months pregnant and unable to fly to Alaska to get him. What can I do to get him and what do I need to do if I have someone go in my place without his father saying Im kidnapping him?

Re: Custody of a Child Out Of State
I don't know how AK enforces its Orders. But, in TX, you could file a Motion to Enforce and require your ex to abide by the orders concerning visitation and support. Since you cannot go to AK, you could provide your parents with a Power of Attorney to stand in your place for these proceedings only. You might be able to go back to the attorney in AK who helped you with your divorce.
