Legal Question in Family Law in Alaska

Long distance divorce

My brother is over seas working. He is a resident of Anhorage Alaska. He wants to get divorced from his wife in Alaska, but he doesnt know how to do a divorce from overseas. I live in Florida and want to help him find a lawyer, but I know the laws here in FL and AK are not the same. How do we find a lawyer to help him? Can he get a divorce if he is not in the country?

Your brother can divorce her regardless of his location. You can assist him with the process by retaining your own legal counsel here in Florida.

If your brother is an Alaska resident, he is entitled to a divorce in Alaska. However, unless the Alaska court has personal jurisdiction over his wife, no other issues other than a bare-bones divorce can be granted. Thus no property or debt allocation, no custody issues. Indeed, ALaska would also have to be the home state of the child(ren) for any custody issues to be heard. If your brother just wants a divorce, it can be granted. My experience with out of country divorces is that they are often difficult to orchestrate, primarily because the wife has to be served in conjunction with the Hague COnvention, which basically means translating the paperwork into her language and serving it via international process server at an astronomical fee.
