Mistaken Identity

In May of this year I was summoned as a suspect in a case of hit and run. I presented evidence to the DA, showing that I was at work during the time the accident occured. My case was dismissed without ever going to court.

The insurance company of the vehicle that was hit claims that they have done their own investigation, proving that I was involved in the accident, and they want me to pay roughly three thousand dollars in damages. I have never been contacted by the insurance company, other than with letters saying how much I owe.

What do I have to do to get this nightmare over with? What rights do I have, IE can I hire an attorney and effectively file a lawsuit against the insurance company for harrassment? I can't afford an attorney, and the only way for me to do so would be to be able to file a lawsuit against this company.

Any help you could give would be wonderful.

Do you have any auto insurance? If so, turn this in to them. They will defend and hire a lawyer for you if necessary.

If you do not want to do that, then write the other insurer a letter demanding that they specify what proof they have of your involvement, and for the repair bills.

Then ask your insurance agent to run a report on your driving record, see if this claim shows up, and if it does, go to a lawyer who can sue for damages and perhaps attorneys fees.
