This is a case where a European state defaulted a commercial contract and was responsible in the same manner and to the same extent as a private individual. As a result of this breach a long-year successful development of a company was destroyed. A regular flow of goods and services from the United States was precluded.
The Foreign Sovereign Immunities Act and the case law, especially the case of SIDERMAN DE BLAKE V. THE REPUBLIC OF ARGENTINA 965 F.2D 699 (9th Cir. 1992) provide material and legal analogies on a scale close to this case. The SIDERMAN comprises state’s commercial defaults together with torts and human rights violations, which are very similar to the case and can be useful in creating of a persuasive argumentation for the court.
At the same time the acts and their consequences in this case are sufficient to invoke the ''direct effects'' test under the Statute and will be suitable to satisfy the requirements of section 1605(a)(2).
