Bankruptcy on Co-Sign of Vehicle
Almost 6 years ago, my boyfriend at the time in Arizon, co-signed on a vehicle for me. We have gone our seperate ways but remain in contact. He recently filed for bankruptcy. So of course, on his record it shows 2 vehicles. One his, one mine. His vehicle is already paid off. I have the vehicle here in Tennessee for the past 4 years now and I am the only one who has been making payments for the vehicle all this time. The vehicle will be paid off in March 2006. When he goes to court, what will happen? Does he have to surrender my car back to Nissan since he did co-sign?

If the debt is included in the petition, the debt can be discharged, meaning he has no further obligation to pay. This discharges him only, you would have to continue to pay if you intend to keep the vehicle.
