can a person with mental illness file bankruptcy? this person has no steady job but has been given credit cards and car loans, on which he cannot pay back. till now his debt has been paid by a family member.

Yes. A mentally incompetent person can file bankruptcy. I filed a bk for a client with a similar case a few years ago. You should contact an attorney in your area regarding how to proceed. Good luck.

It depends how serious the mental illness is. If the person has limitation to understand business transaction there should be a conservator. If capable the person can file for bankruptcy.
