Legal Question in Bankruptcy in Arizona
bankruptcy/divorce
If in my divorce decree, my soon to be ex-husband stipulates that I must repay credit card debt (to which he is the primary card-holder) incurred during our non-legal separation, can I roll that debt into my bankruptcy for elimination?

Re: bankruptcy/divorce
Absolutely...and you should. When you file for bankruptcy, a meeting will be held where you will be asked if you listed all of your assets and all of your debts. If you want to answer yes honestly, you'll need to list everything. He could re-open the divorce settlement to get some of the assets, though, in the event that he is forced to pay the debts. If he files bankruptcy, too, though, he won't be able to come after you for anything.
I actually practice in family and bankruptcy law and divorce and bankruptcy are going hand-in-hand now. If you have any questions, please give me a call, I practice state-wide for bankruptcy.
