Legal Question in Bankruptcy in Arizona
We are recently married. Each spouse entered marriage with extensive credit card debt. My unsecured debt was roughly $30,000. My husband debt was $8,500. We are considering bankruptcy for my husband since he is unemployed and has zero income. However, we live in community property state. Will my income be considered in determining whether he qualifies for bankruptcy? My income is also used to pay all household expenses.

The debts prior to marriage belongs to each one of you independently of your marriage. Your income will be considered in making the initial determination whether you can file for Bankruptcy since you are a part of the household. Be aware that whether a person is working does not determine qualification for Bankruptcy.
