Breach of Contract

I bought a commercial building with out on a contract. The seller did not disclose the faulty septic tank. I resold the building with a disclosure, the person I bought it from owes me $50,000 and will not pay. What can I do? The contract we had expired, and I tried in vain to contact him to sign an extension so that I could sell it. He failed to do so, but through email he stated he would fund my account when escrow went through. This did not happen. I have the emails. Can some one please tell me what I can file to retrieve me money? Thank you.
