Legal Question in Business Law in Arizona

Business Ownershp

I started a business with my wife. On the LLC papers that she completed she listed me as a Manager instead of a Member. She is now trying to take complete ownership of the business. What legal actions can I take to get access to all financial stamtenets and revenue. The business is a small restaurant and catering company. We didn't do an organizational operation to start. She is using a Legal Order of Protection to deny me access to the property. What should I do.

You should take legal action to protect your interest in the business. You have more authority over the LLC if you are the Manager, than merely a member. You can take action to enjoin (stop) her from using the business for her own benefit, gain access to the books and records, and limit how the money earned by the business is distributed. If you have no operating agreement, then the LLC may be treated as a partnership under the law. You need some one to analize the facts for you and recommend a strategy to achieve your goals.
