Legal Question in Business Law in Arizona

Civil Complaint Law suit to LLC after business is closed.

I own a small car lot,it is an AZ LLC.

Business will be closed in a week.

we are been sued by a client for 9000.00 for a truck that was sold for 8800.00 Plus taxes title and license, (we paid to an external warranty company to protect vehicle for 3 months or 3000 miles which ever comes first.)

In AZ dealers are responsables for only 15 days or 500 miles which ever comes first. client had vehicle for over a month and it broke down, warranty company didn't cover the repair.( customer said he had to pay over 7000.00 dolars and that he has receipts)

now he has filed a civil complaint law suit and the court date is going to be after the business is closed.

First of all, Can he win? and if he does, Can we be liable for it personally? Thank you

You forgot to mention if you were personally named in the lawsuit, or not. That is a pivotal issue. You have to be named, served with process and be a defendant to have a judgment rendered against you.

Was the warranty company sued? If not, your company should file a cross-claim against it, and should list it as an additional party at fault in the lawsuit.
