Legal Question in Business Law in Arizona
Common Law Trademark
If someone applies to federally trademark my business name (i.e., tries to steal the name from me) before I do, will my common law trademark rights protect me? In this situation, I would have used the trademark first (and registered it as a DBA name with my state) and even have a website set up for my business. Also, if they somehow succeeded, would my rights to the name be completely gone?
