Legal Question in Business Law in Arizona
If a company is operating under a non-registered dba and I form a company (LLC) of my own using the same name as the non-registered dba, who has the rights to use the name? Also, can I ask they not use the name anymore?

As a franchise attorney I can tell you this. Whether or not a DBA is registered or not has nothing to do with trademark or service mark rights. If you infringe on these rights, you can be sued for trademark infringement. Consult with a good business or franchise attorney in your area for specific advice.
