If an employee is laid off can their position be filled?
I have been laid off and offered a severence. However the company that i worked for is hiring someone else for my position. Is this illegal? The layoff was a complete surprise. I work remotely from home for a database management system. I was told that I was being laid off due to department restructuring. Can that company now hire someone in my place?

This is not a business law question, but an employment/labor law question. Please re-submit. When you do, provide more facts. Do you have a written contract of employment? Does the company have a written or established policy on termination or length of employment? Have you had write-ups that were unfavorable?
