Is illegal labor a legal element of a contract?
If a contractor hires an employee that is not legally eligible to work, and uses the labor of that employee to fulfill a contract, is the contract still valid or may it be voided at the discretion of the customer?
Is the labor of a person not legally eligible to perform a given task illegal in the eyes of the law?

Having only the hypothetical facts you describe, I would advise you that the contract is not invalidated because the contractor has used "illegal immigrant" labor on the job.

Too few facts to say, but it sounds like the contractor fulfilled his part of the contract, and you are trying to strain to get out of yours. Correct?
And what do you mean by "ineligible to work?"
