Legal Question in Business Law in Arizona
Right of Publicity... I am on website w/ out permission
My husband and I have been in a long, drawn-out business venture with his father. We originally went to work for his firm as independant contractors with the promise to eventually acquire this particular branch of his company as our own. Eventually, bad went to worse as the business relationship developed. We have since started our own business in the same field, in the same city. There are no non-compete issues, but his father continues to post our pictures and resumes on his company website under the guise that we are still with the company. We have verbally requested removal of such information, and recently submitted two fax requests for removal. The business relationship has been severed for almost 10 months. Since we are operating a similar business in the same city, I believe this is not only a violation of our right to pblicity and privacy, but also falls under the unfair competion law. Do we have such a case against him?

Re: Right of Publicity... I am on website w/ out permission
Yes, but you will probably need to consult with an attorney to enforce your rights or force him to remove the information.
Did you resign from all corporate or company positions so that you will not have ongoing liability for debts as well?
See an attorney--you are in the right. There is also a tort claim for unauthorized use of identity in advertising.
