Legal Question in Business Law in Arizona
I recently ended a partnership which the other partner kept the business and the lease to the rented space. When we originally signed the lease the tenants before left rooms of furniture and office supplies. The property manager told us that she would have someone come and remove and throw all of the stuff away. We asked if we could go through it and keep what we wanted and we would throw out what we didn't want. When I left I took the desk with me. My old partner told me to return the desk and now the landlords lawyer is telling me that it is property of the landlord and to bring it back. We threw so much away and the other partner sold the rest. Do I have to bring it back if they gave it to us.

Any attorney will say if you had the permission of the property manager who is an agent of the landlord, that permission binds the landlord. However, is a desk really worth fighting over? And your x-partner apparently is claiming it as his share of the business - another potential fight. And all this over a used desk? Consult with a good business attorney in your area for specific advice.
