Repayment of signing bonus
When starting my current job, I signed an employment contract stating that I would receive a $10,000 signing bonus but I would be required to stay for two years. A clause in the contract states that if I leave at any time within the two years I will have to repay the entire amount. After one year, however, I was transferred to a new location with the same company and signed a new employment contract that mentioned nothing about repayment of the signing bonus.
My questions are as follows:
1. Would it be possible for the company to enforce the ''complete repayment'' clause or would it be more likely that I would have to pay a pro-rated share based on my time of employment?
2. Would signing the new employment contract (which contained no mention of repayment of the signing bonus) invalidate the original payment clause in the first contract?
