royalty rights
My husband and I have our own business. He is devorced 12 years now with 2 children 16yrs and 14yrs old. He shares joint custody and wants to know if he uses the girls firsts names in our menu board can SHE or they Sue us for royalty fees or anything like that.

When using anyone's name, picture or identity in a commercial setting for advertising, trade use or commercial use always get a proper written consent form signed in advance, or don't do it. The problem here is that a minor cannot sign it. When they are 18, any consent, whether by their parent or by themselves, can be set aside. Photographers alway get model releases from those they take pictures of, even in public, if they intend to use the photos for commercial use. This seems like overkill in a family setting, but by the nature of your question it may be prudent.
