Legal Question in Business Law in Arizona
I would like to start a business mystery shopping automotive dealership service departments in Arizona and I was wondering if it is legal to use hidden cameras to assist me in the evaluation of employees. I would not show the video to anyone, I would only use it for reference and evaluation purposes. If a dealership hires me to do this, would they be required to alert employees beforehand, such as telling them that they will be mystery shopped, but not giving specific times or dates? If I do not intend to show the video to anyone, would I need the employees permission to take the footage? I don't want to encounter any legal issues, so any information you could provide would be appreciated. Thanks a lot.

Yes - you would need the employee's prior authorization. The best place for such authorization is to simply include it in your employee handbook, which all employees should sign as a condition of working for you.
