supposed work completed on a property I sold
I asked an electrician to do work on a
second home we had in Pinetop, AZ
prior to selling it. I never recieved
notification of it being completed or
an invoice. I tried at least 4 or 5
times to call for an update and
invoice and nothing. The work took
place 9/27/95 according to their
invoice I recieved yesterday 4/1/09.
They are taking me to small claims
court for double the amount for
interest for 3 and 1/2 years and
court fees. Is there a statute of
limitations on billing? I know in
2003 it was 3 years for verbal and 6
years for written. I wanted to make
sure this is still in effect and also to
see if it has truly passed the
limitation. I think it stated that it
was 3 years from default and I am
not sure how long from 9/27/05 it
would be in default.

Yes, there is a statute of limitations on contracts. Did you have a written contract? What was the amount invoiced? You said that you were not invoiced and that the suit is for double the amount, which is it? Does the electrician have a contractor's license?
There would seem to be a number of arguments that could be made in your favor.
