Legal Question in Business Law in Arizona
taking over an expired tradename registration
When I incorporated my business about 4 few years ago --name removed--corp in Arizona), the name I wanted to use was already registered by someone as a tradename in my state, so it wasn't available. Now, the tradename will be available because the person has not renewed the registration. I would like to change my corporate name to this other tradename. However, if that other business had any problems (judgements, debts, etc.?) and I change my name to that tradename, should I be concerned that those problems/claimants come after me - thinking it--name removed--the same company? How much of a concern is this and can I do anything to prevent it? If it does happen, is it easy to straighten out, without attorneys and expense?
Thanks!

Re: taking over an expired tradename registration
The company with this trade name can be reinstatet, and than you would have a problem. As long as this company has a chance to be reinstatet do not take on the name.
